1. ⚠️ Critical Safety Warning

DANGER — RISK OF SERIOUS INJURY OR DEATH

Working with parking equipment, access control systems, electrical panels, mechanical gates, and related automated systems involves serious hazards including but not limited to electrical shock, electrocution, arc flash burns, crushing injuries, pinch points, entanglement, falls, and death.

ATLAS provides troubleshooting guidance only. It does not and cannot assess the physical conditions at your job site. No app, system, or remote guidance can replace your direct observation of hazards, your professional training, or your judgment about whether a task is safe to perform.

NEVER rely solely on ATLAS guidance when working on energized equipment, mechanical systems under tension, or any system that could cause injury. If you are unsure whether a task is safe, STOP WORK and consult a qualified professional.

2. Your Safety Is Your Responsibility

By using ATLAS, you acknowledge and agree that:

ATLAS cannot see your work environment. Only YOU can assess whether it is safe to proceed with any recommended action. Conditions such as wet surfaces, damaged wiring, missing covers, improperly grounded equipment, or other site-specific hazards are invisible to ATLAS.

3. Advisory Guidance Only

ATLAS provides troubleshooting suggestions based on common industry practices and accumulated field knowledge. These are recommendations only — not directives, not instructions, and not professional engineering advice.

You must use your own professional judgment and assess all risks before taking any action. ATLAS guidance:

4. Professional Qualifications Required

Many repairs and troubleshooting tasks described in ATLAS require licensed professionals. Do not attempt work that exceeds your training, certification, or licensing.

When in doubt, STOP. Contact a qualified professional. No troubleshooting session is worth risking your life, your livelihood, or someone else's safety.

5. Manufacturer Guidelines Supersede

Always consult and follow the equipment manufacturer's official documentation, safety guidelines, and service procedures. ATLAS guidance does not replace or supersede manufacturer instructions.

If ATLAS suggests an approach that conflicts with the manufacturer's documentation, always follow the manufacturer's guidelines. Report any discrepancies to us so we can improve our knowledge base.

6. Known Hazards & Required Procedures

The following hazards are commonly present when working with parking and access control equipment:

⚡ ELECTRICAL HAZARDS
Equipment may operate at 120V, 208V, 240V, 277V, or 480V. Arc flash and shock hazards exist. Always verify zero energy state with a properly rated voltmeter before touching any conductors. Never trust a circuit breaker position alone — verify with a meter.
⚙️ MECHANICAL HAZARDS
Gate arms, barrier operators, and motorized systems can start unexpectedly. Spring-loaded mechanisms store energy even when power is disconnected. Pinch points exist at hinges, chains, sprockets, and linkages. Keep hands, clothing, and tools clear of moving parts.
🌧️ ENVIRONMENTAL HAZARDS
Outdoor equipment is exposed to weather. Wet conditions increase electrical shock risk. Extreme cold can make materials brittle. Heat can cause burns on exposed components. Lightning can damage electronics and create ground faults.
🚗 TRAFFIC HAZARDS
Parking equipment is located in active traffic areas. Use appropriate traffic control measures, high-visibility clothing, and never position yourself between active traffic lanes and the equipment you're servicing.

7. Acceptance of Terms

By accessing or using ATLAS ("the Service"), operated by On Spot Solutions LLC ("Company," "we," "us," or "our"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"), including the Safety Disclaimer above. If you do not agree to all of these Terms, you may not access or use the Service.

Your use of the Service constitutes acceptance of these Terms and any supplemental terms, policies, or guidelines referenced herein. These Terms apply to all tiers of the Service, including Atlas Lite, Atlas Free, Atlas Pro, Atlas Pro+, and Atlas Business.

8. Service Description

ATLAS is an expert troubleshooting platform for parking and access control equipment, providing diagnostic guidance for gates, pay stations, LPR cameras, CCTV systems, networking equipment, and related automated control systems. The Service is available through web browsers and progressive web applications (PWA).

9. Accounts & Authentication

Certain features of the Service require account creation. By registering, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your authentication credentials and for all activities under your account.

You must notify On Spot Solutions immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.

10. Amps & Subscriptions

ATLAS uses a consumption-based system called "Amps." One Amp represents one troubleshooting session. Additional Amp costs may apply for voice output, photo analysis, and session re-engagement as specified in the current tier documentation.

Subscription Amps are granted monthly, are non-transferable, and may not be exchanged for cash or credit. Unused subscription Amps may roll over according to your tier's rollover allowance, and any remaining balance expires at the end of the following billing cycle.

Purchased Amps do not expire and are consumed only after subscription and rollover Amps are depleted. Purchased Amps are non-refundable except where required by applicable law.

The Company reserves the right to modify tier pricing, Amp allocations, and consumption rates with thirty (30) days' prior notice.

11. Intellectual Property & Proprietary Rights

The Service, including but not limited to its troubleshooting methodologies, diagnostic pathways, pattern libraries, knowledge base content, system prompts, conversational flows, voice interactions, user interface designs, source code, algorithms, data models, and all related documentation (collectively, "Proprietary Materials") are the exclusive intellectual property of On Spot Solutions LLC.

The Proprietary Materials are protected by United States and international intellectual property laws, including copyright, trade secret, trademark, and patent protections where applicable.

You acknowledge and agree that: The troubleshooting guidance, diagnostic methodologies, and pattern-based intelligence delivered through ATLAS constitute trade secrets and proprietary know-how of On Spot Solutions LLC. The value of these materials is derived from their confidential nature and the substantial investment of time, expertise, and resources required to develop them.

No license, right, title, or interest in any Proprietary Materials is granted to you except the limited right to use the Service as described in these Terms. All rights not expressly granted are reserved by the Company.

12. Confidentiality & Non-Disclosure

By using the Service, you agree to treat all information obtained through or about the Service as confidential. "Confidential Information" includes, without limitation:

These confidentiality obligations survive termination of your account and remain in effect for a period of five (5) years following the date of last access to the Service, or for the duration of trade secret protection under applicable law, whichever is longer.

Enforcement: Unauthorized disclosure or use of Confidential Information may result in immediate termination of your account, injunctive relief, and recovery of damages, including but not limited to lost profits, legal fees, and any gains derived from the unauthorized use.

By using the Service, you acknowledge and agree that On Spot Solutions LLC may collect, store, and analyze:

This data is used to provide the Service, improve troubleshooting accuracy, develop new features, identify patterns in equipment failures, and enhance the knowledge base. We do not sell your personal data to third parties.

Knowledge Base Contribution: Anonymized patterns and insights derived from your troubleshooting sessions may be incorporated into the ATLAS knowledge base to improve the Service for all users. This derived knowledge becomes the property of On Spot Solutions LLC.

Your equipment data stays yours. While we may use anonymized patterns to improve ATLAS, your specific site information, equipment inventories, and business details are never shared with other users or third parties.

15. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

On Spot Solutions LLC does not warrant that: (a) the Service will be uninterrupted, error-free, or secure; (b) the troubleshooting guidance will resolve every equipment issue; (c) the information provided will be accurate, complete, or current for all equipment types, brands, and configurations; or (d) the Service will be compatible with all devices or operating environments.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ON SPOT SOLUTIONS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

IN NO EVENT SHALL THE COMPANY'S TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU TO THE COMPANY DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

17. Indemnification

You agree to indemnify, defend, and hold harmless On Spot Solutions LLC and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or relating to: (a) your use or misuse of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) your breach of the confidentiality obligations herein; or (e) any injuries, deaths, property damage, or other losses arising from actions taken based on troubleshooting guidance provided by the Service.

18. Termination

On Spot Solutions LLC may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to: violation of these Terms, suspected breach of confidentiality, attempted reverse engineering, abuse of the Service, or non-payment of fees.

Upon termination: (a) your right to use the Service ceases immediately; (b) any outstanding Amp balances are forfeited unless otherwise required by law; (c) the safety disclaimer, confidentiality, intellectual property, limitation of liability, and indemnification provisions of these Terms survive termination.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Suffolk County, Massachusetts.

Any claim or cause of action arising from or related to the Service must be filed within one (1) year after such claim or cause of action arose, or be forever barred.

20. Changes to Terms

On Spot Solutions LLC reserves the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification at least thirty (30) days before taking effect. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.
